Record Expungement and Record Sealing Explained

Expunging records and sealing records have very similar results in how they impact your life. In both cases a criminal record becomes invisible to the general public, including most potential employers, and will not be revealed by a public records search. The major difference is in their requirements and the access that law enforcement officials have to your records. 

Expungement

If your criminal record is expunged, all copies of your record are physically destroyed, except for one copy that is held permanently by the Florida Department of Law Enforcement. Local law enforcement agencies will not have access to an expunged record in most cases. Criminal or arrest records are only eligible for expungement if the charges on record were dismissed and you have never been adjudicated guilty of any other crime. 

Sealing

Sealing a record means it is concealed from public view; it cannot be reported in a public records search or be made available to anyone other than law enforcement and certain other government agencies. However, law enforcement officers still have access to sealed records. To qualify for record sealing in Florida, you must have pleaded ‘guilty’ or ‘no contest,’ and had your adjudication of guilty withheld by the judge. You must also have never been adjudicated guilty of any other crime.
